The Lyrics

By using filibusters and other delaying tactics, Democrats in the Senate have been making it difficult for President Bush to fill judicial vacancies. Of course, Republicans also played games with Bill Clinton's appointments. Now California Supreme Court Justice Janice Rogers Brown has been nominated to the U.S. Court of Appeals for the District of Columbia, and this parody portrays the inquisition of Justice Brown by her opponents on the Senate Judiciary Committee.
Justice Brown, will you please walk on water?
While you're at it, make a mountain move.
We have set - our double standards high
And made it clear enough you might not get approved.

We're leading you, like a lamb, to slaughter,
Even though we don't know tarts from torts.
We won't change our long-held points of view.
Judges who disagree we don't want on our courts.

We checked you out, and we're playing rough, so
We had no doubt that we'd find some good stuff

Justice Brown, we've looked through police blotters
And although we did not find your name
When we kept - looking back through the years,
It became clear enough that you were a wild young dame.

We checked you out, and we're playing rough, so
We had no doubt that we'd find some good stuff

Justice Brown, about that teeter totter,
You got 'time out' for pushing too hard.
And we've heard - you ripped off mattress tags.
And that you once jay walked without a crossing guard.

Justice Brown, will you please walk on water?
Justice Brown, will you please walk on water?
Justice Brown, will you please walk on water?
Justice Brown, will you please walk on water?
Even though putting up roadblocks to the nominees of the opposing party is a standard political procedure, the objections raised to Justice Brown seem particularly disingenuous. Even though she has been endorsed by several liberal law professors, her critics say that she is "out of the legal mainstream" largely because she opposes affirmative action. It is true that she wrote the decision that affirmed the constitutionality of California's proposition 209, which banned race preferences by government institutions, but the proposition passed with 55% of the vote and the Court's decision was unanimous. Is the rest of the court and are all Californians out of the mainstream?

I like the obviousness of the old double standard fare. Will they ever grow out of it? A really good one! 5's

Has to be the most educational song of the "J" bunch. As long as Congress and the President are from opposing parties, they'll be butting heads (no matter which president is up there).

With the exception of GWB's, perhaps, the longest-lasting impact of any administration is the justices that get appointed. So of course each side is going to sabotage the other's nominees.

Oh yeah, the parody. More great stuff, Johnkins. Fave line: "We have set our double standards high."
